Terms of condition for the competition of the domain nfg-raffle.com

The following terms of conditions are for the competition of the nfg-raffle.com domain, which is organized by ART2PEOPLE, Graf-Zeppelin-Platz 1, 71034 Böblingen. Further contact details can be found in the imprint.

The competition is hosted of the organizers domains. The prizes, the dates of participation and the way in which the prizes are awarded can be found in the competition announcement by the organizer.

1 Scope

1.1 The present terms of conditions for the competition, which is advertised on the organizer's domain.

1.2 If you participate in the competition, the current and displayed terms of conditions apply.

1.3 The terms of conditions also apply if the platform is accessed from outside the Federal Republic of Germany. As a result, the participant accepts Germany as the legal location for the competition.

2 Eligible participants

2.1 Only NFT buyers of the campaign “NFG – G-Class Raffle by ART2PEOPLE” are entitled to participate.

2.2 The eligible NFTs can be found on the following page: https://www.art2people.digital/.

2.2 Participation is only possible, if you are at least 18 years of age. Also the ownership of an own e-mail-address is required.

2.3 Employees, authorized representatives and representatives of the organizer and their respective family and household members as well as all persons who are disqualified according to number 8 of the conditions of participation or who are excluded from the competition or blocked are not eligible to participate. If these requirements are not met, all claims against the organizer are void.

2.4 Participation is only possible if correct user data are provided.

3 Participation

3.1 Participation in the competition requires ownership of an NFT or a redeemed NFT of the campaign “NFG – G-Class Raffle by ART2PEOPLE”.

3.2 Each buyer of an NFT will receive an invitation link to a landing page after the Redeem Event where registration will take place. Playing on behalf of third parties or participation via "straw men" is not permitted.

3.3 Participation via the Internet takes place through corresponding online registration with the specification of the Nifty gateway account link, Nifty Gateway Account Name, e-mail address, date of birth and the country you live in. If the Link to the Nifty Gateway or the Nifty Gateway Name does not exist or is incorrect, it is not possible to hand out the prize.

3.4 Each participant can only be registered and drawn once. The chance of winning increases with each additional NFT registered or when they are redeemed.

3.5 Participation in the competition is only possible if registration took place on the organizer domain by midnight on the day before the draw. The system time of the server applies.

3.6 Each participant will take part in the draws as announced at the Sweepstakes.

4 Sweepstakes and Prizes

4.1 The start date and the possibility to register for the competition is April 12th, 2022

4.2 The closing date for entries is April 23rd, 2022.

4.3 Drawing days for the prize is May 1^st 2022.

4.4 A Mercedes G-Class will be raffled in the competition. The model, engine and year of manufacture will be announced. The participant is responsible for picking up and transporting the vehicle. ART2PEOPLE subsidizes the transport or the admission in the home country of the winner with up to 1,500€. The car is handed over de-registered.

4.5 In order to be drawn for the raffle, the participant must be on the snapshot list that was saved on March 30th. 6 pm.

4.6 The winner will be determined by drawing lots from among the participants who have been activated by the day of the drawing.

4.7 If a prize notification fails, the claim to the prize is expired. In this case, a substitute winner will be drawn from the participants available on the day of the draw.

5 Notification of Entrants, Winners and Payment of Prizes

5.1 The winners will be notified by the organizer.

5.2 The winner must contact the organizer with datas of registrations within one month of being notified of the draw. You must then identify yourself as the winner (by presenting the wallet information) and sign a confirmation of your win. If this does not happen, the prize is forfeited.

5.3 If the data transferred is identical to the data stored on the organizer's domain, the prize will be handed over as agreed.

5.4 In the event of a dispute, especially if there are discrepancies about the name, the data stored on the organizer's domain are decisive for the data comparison.

5.5 With his/her participation, the participant gives the organizer or its service provider express permission to publish the wallet address on the Internet in the event of a win.

6 Loss of entitlement to prizes

If a prize notification fails because the prize notification was not delivered to the address details provided, the prize claim expires. Unsuccessful delivery to one of the address details provided (e-mail address) is deemed to have failed to deliver the prize notification in this sense.

7 Limits and Taxes

The right to win is not transferable to third parties. The right to receive the prize in cash is excluded. The winner has to pay for any taxes that may be incurred, insofar as it is a tax claim from the tax authorities.

8 Rules of Conduct, Disqualification and Suspension

8.1 The organizer has the right to disqualify and exclude participants from the competition who influence the participation process in a way that violates good faith, e.g. by manipulating the software or violating the game rules or their behavior in any other way exceeds the limits of what is reasonable, e.g. through threats or unreasonable harassment (insult, slander, extreme number of calls in the form of "telephone terror" etc.) of employees of the organizer or its service providers.

8.2 Furthermore, the organizer or its service provider can also exclude participants from participation at their discretion in advance if a violation of the provisions in Section 8.1. listed rules of conduct threatens.

9 termination/change options

The organizer reserves the right to interrupt or terminate the competition at any time without prior notice, provided there is a legitimate interest in doing so. This can be the case in particular in the case of technical problems or legal concerns.

10 legal process

The legal recourse of the participant is excluded. There is no enforceable claim to the payment of the winnings.

11 Privacy and Consent

User data is processed with the utmost care and in compliance with statutory provisions. The processing of the data entered in the entry form takes place exclusively on the basis of your consent (Art. 6 Para. 1 lit. a GDPR), which you give us by your voluntary participation in this competition. 12 Liability

12.1 In the event of a link to the websites of partners, sponsors and advertising partners, the organizer has no influence on the linked sites. He does not adopt their content as his own.

12.2 Liability for data loss is limited to the typical recovery effort that would have occurred if backup copies were made regularly and appropriate to the risk.

13 Severability Clause

Should individual provisions of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected.

14 Final Provisions

Changes or additions to these Conditions of Participation must be in writing. The competition is exclusively subject to the law of the Federal Republic of Germany.
